Uncontested Divorce vs Contested Divorce

Nevada has two types of divorce. Lots of states do, but Nevada has what is called a “quickie divorce”. Its kind of like quickie sex, the kind you might have with a prostitute which Clark County, Nevada also offers. In this divorce you must “move” to Nevada but only for six weeks before the divorce filing. Then someone has to have personally witnessed you in Nevada for two or more days each week for those six weeks and sign a “resident affidavit” saying you are a resident.

As you can imagine this quickie method is ripe for fraud. At it’s core, to avoid it being a complete sham and fake law is a core requirement that one party must be in Nevada physically present for six weeks before the divorce is filed. If they leave Nevada during that time and come back they must have the “intent to reside” and “intent to reside indefinitly”. This means you can’t have plans to leave Nevada.

Nevada Supreme Court has been pretty clear that physical presence is synonymous with residency for divorce. This is pretty stupid in my case because I was not physically present in Nevada for the six weeks prior to my ex filing the paperwork. I also had given my notice in January, 2024 that I intended to depart Nevada and seek work in a different state. I notified my ex of this in writing even though I had no legal obligation to do that since we had no legal custody agreement in place.

Knowing that I was moving, my ex’s lawyer filed an injunction saying I couldn’t move. He had already sent me an email saying moving was no problem so I thought the injunction meant that I should not move out of California. I had already given notice to leave my apartment and since it was in demand the apartment manager had already re rented it.

It was a fabulous vacation apartment right behind the sphere with a fab view of the strip from the rooftop game room with a triple glass sliding wall to the outdoor patio. A fabulous place to watch the Formula One race, which is the main reason I brought the minor child to Las Vegas in the first place. The minor wanted to see the first ever F1 race in Las Vegas and the lead up to the race did not disappoint.

They dug up trees, built roads and buildings. Built a temporary bridge on Tropicana Ave. Drained the Bellagio Fountains. It was quite a production and every day as we drove around we saw it all and walked on the racetrack days before the race. We stayed a block off Sands and Koval at the heart of it all. As an added bonus we were there when they lit up the Sphere and when some climber tried to climb it.

But after that and a Unique Christmas Season filled with a Cactus Garden and Sequined Jumpsuit Violinists playing Christmas Carols and Back in Black we were READY TO GO! Back to our homeland of California.
